1. GENERAL
1.1. NA-KD.com is a website operated by Nakdcom One World AB (hereinafter referred to as "NA-KD", "us" or "we"), a company registered in Sweden under registration number 556971-2002 with its registered office at Väverigatan 14, 41502 Gothenburg, Sweden.
1.2. Our VAT identification number is SE556971200201.
1.3. NA-KD can be contacted regarding all questions concerning these Terms and Conditions and questions relating to orders and purchases at the following email address: customercare@na-kd.com.
1.4. These General Terms and Conditions ("GTC") govern the terms of sale for all orders placed by customers (hereinafter referred to as "you" or "customer") on the domain na-kd.com, all subpages of the domain na-kd.com, mobile websites, or the mobile app, from the moment you place an order until payment and delivery. By ordering a product, you agree to be legally bound by the following terms of these General Terms and Conditions.
Please ensure that you have read and understood these terms before placing an order.
The customer and NA-KD are hereinafter collectively referred to as the "parties".
1.5. NA-KD reserves the right to amend these Terms and Conditions from time to time. The new version will not be retroactively effective, and the parties are only bound by the Terms and Conditions that are online on the day the order is placed.
1.6. In these General Terms and Conditions, the following terms shall have the meanings ascribed to them below:
a) "Site" refers to the domain and subdomains of www.na-kd.com and the mobile app.
b) "You" refers to the customer placing an order.
c) "Customer" refers to the person placing an order.
d) "Business Day" refers to a day that is neither (i) a Saturday or Sunday, nor (ii) a public holiday in the Customer's country.
e) "Order" refers to the order placed through our Site to purchase products from us.
f) "Content" refers to all text, graphics, videos, images, and all other information published on the Website.
g) "Third-Party" refers to all websites not provided by NA-KD.
h) "Contract" refers to the order you have placed to purchase products in accordance with these Terms and Conditions.
i) Words expressing the singular include the plural and vice versa.
2. CONCLUSION OF CONTRACT
2.1. By placing an order on the website, we are offering you the opportunity to purchase products that are subject to these Terms and Conditions.
2.2. The service is intended exclusively for persons over the age of 18. If you are under 18, your parent or guardian is responsible for supervising your use of the service at all times and ensuring that you comply with these terms.
2.3. The parties agree that the photographs of the goods offered for sale on the website have no contractual value.
2.4. NA-KD reserves the right to refuse and/or block purchase requests from you for legitimate reasons, such as if we are unable to process your payment, if a product is out of stock, or if NA-KD suspects that you are purchasing products for commercial and/or business purposes. If your order is accepted, we will inform you by email as described in section 2.5.
2.5. Our website will guide you step by step through the process of completing your purchase and placing your order. You will be shown a summary of the essential information about your order before you submit it. We strongly recommend that you check all the details of your order before purchasing, as we cannot guarantee that we will be able to change your information afterwards.
2.6. You will receive a confirmation email once you have placed an order. This email is only a confirmation of your order and does not constitute a purchase agreement. A contract for the purchase of the goods between us and you is formed once your payment has been approved by us, we have charged your credit or debit card, and your order has left our warehouse.
2.7. Product availability depends on stock levels. If a product is sold out between the time you place an order and the time it is processed by our warehouse, we will cancel the purchase of that product as it is no longer available. In this case, we will notify you and issue a refund.
2.8. If for any reason we are unable to fulfill your order, you will receive a cancellation email. If payment for such a cancelled order has already been processed, you will receive a refund of the same amount via the original payment method. If any further arrangements are necessary, NA-KD will contact you.
3. PRICES AND PAYMENT
3.1. The prices listed on the website apply to all orders placed through the website. All prices include statutory VAT (where applicable). Shipping costs are calculated separately and are clearly displayed in the "Total" section.
3.2. NA-KD reserves the right to change and update information at any time without prior notice. This includes errors in prices, details, and descriptions on our website.
3.3. If incorrect information has been provided for a product you have purchased, please contact our customer service department under the conditions stated in "1. General".
3.4. We offer various payment options. You will find the payment methods available for your country during the checkout process.
Please note that we do not accept cash or checks.
3.5. All payments are subject to validation and authorization by your chosen payment service provider. If the provider refuses or does not authorize the payment for any reason, you will be notified by email and/or during the order process.
3.6. Occasionally, we offer special deals and discounts on certain items on the website. The terms and conditions for a special offer or discount will be specified at the time of the respective promotion.
3.7. We reserve the right to withdraw these special offers or discounts at any time and without prior notice.
3.8 At checkout, you have the option to support our sustainability initiative with a small donation of approximately €1 (this may vary depending on the currency). By actively agreeing to the donation, you (i) agree to pay this amount and (ii) accept that this donation is non-refundable.
4. SHIPPING AND DELIVERY
4.1. Shipping costs are calculated in addition to the purchase price of your product, which will be clearly displayed where applicable and included in the "Total" section at checkout.
4.2. We perform a pre-authorization check on the card used for the purchase to ensure that sufficient funds are available to complete the transaction. The product you purchased will only be shipped once this check is complete and the payment has been processed.
4.3. You will receive a shipping confirmation email as soon as your order has been shipped. The stated delivery time starts the moment you receive this confirmation email.
4.4. The prices listed on the product pages include VAT and all other price components.
Deliveries are only possible to addresses within Germany and are exclusively handled by DHL.
You can pay with Klarna, PayPal, or credit card.
1. Under €50:
a- Our delivery options are DHL Parcel, Hermes, and Hermes ParcelShop. These options cost €4.95 and take 2-4 business days for delivery to your home or your nearest post office. Your parcel is fully trackable.
2. Over €50
: a- Our delivery options are DHL Parcel, Hermes, and Hermes ParcelShop. These options are free for orders over €50 and take 2-4 business days for delivery to your home or your nearest post office. Your parcel is fully trackable.
4.5. You must provide us with a complete and accurate delivery address, as we cannot guarantee that we will be able to change it after purchase. The customer is solely responsible for any delivery difficulties resulting from missing information or errors in the delivery address when placing the order.
4.6. Our shipping partners strive to deliver your order within the promised delivery time. However, delays are sometimes unavoidable. Please contact our customer service if you have not received your package within the promised delivery time.
4.7. Our transport partners do not deliver on weekends and public holidays.
5. Right of withdrawal, return and refund
5.1 Without prejudice to your statutory right of withdrawal (see below), you may return products (including gift cards!) for any reason up to fifteen (15) days (thirty (30) days for the USA) after receiving your order. Please use the return label included with your order. If you have lost it, please contact our customer service.
For health and hygiene reasons, sealed cosmetic and hygiene products can only be returned if the seal is completely intact. Underwear and swimwear may only be returned with an intact hygiene seal.
5.1.1 If you wish to exercise your right of withdrawal, you can use NA-KD's digital return/cancellation function, which is available during the withdrawal period via My Orders, your delivery confirmation, and our Help Center. This function allows you to specify which order and products you wish to withdraw from or return, and to confirm your request. Once your request has been registered, NA-KD will send you an acknowledgement of receipt. You can also exercise your right of withdrawal by contacting our customer service in writing or by making another clear statement of your decision to withdraw from the purchase. You can also use the model withdrawal form provided by the Swedish Consumer Agency. The form is available further down in these Terms and Conditions and here. After informing NA-KD that you wish to exercise your right of withdrawal, you must return the products without undue delay and no later than 14 days from the date on which you notified us that you wish to withdraw from the purchase.
5.1.2 A full refund is only possible if the goods are in the same condition as when you received your order. If the item has been used (beyond simply trying it on), damaged, washed, altered, or if labels/tags have been removed, we are legally entitled to charge you a fee for the diminished value of the item.
5.1.3 NA-KD will provide you with a return label. A return shipping fee will be charged. You can find more information HERE.
5.1.4 Once your return has arrived at our warehouse and been processed, we will initiate the refund. Processing the return can take up to two (2) weeks from the date you sent the product back. After processing, you will receive a credit confirmation by email. The refund will then be issued within two (2) to five (5) business days.
5.1.5 We do not offer exchanges for returned items. If you would like to order a new item, please place a new order.
5.1.6 All refunds will be issued via the same payment method you used for the purchase. If you paid by invoice, your payment provider may contact you to process the refund. We will refund all payments received from you, including delivery costs (excluding any additional costs incurred because you chose a delivery method other than our standard delivery option). Refunds do not include any customs duties or import fees you may have paid, nor your potential contribution to our sustainability initiatives (e.g., climate contribution).
5.2.1 As a consumer, you always have a 14-day right of withdrawal, but we offer you a 15-day return policy. Please note that you can only return products that you purchased through the website.
5.2.2. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract within 14 days of receiving the goods. This can be done by email, letter, or other clear communication. Once we have received your notice of withdrawal, you have 14 days to return the goods. The deadline is met if you send the goods before the 14-day period following your withdrawal has expired. If the goods are returned later than 14 days after the notice of withdrawal, we may still accept the return depending on the circumstances; however, this is outside your statutory rights.
5.2.3 The right of withdrawal does not apply to the following contracts: Contracts for the supply of sealed goods which are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. This applies to swimwear, make-up, underwear and other hygiene products.
5.3. Special Notes
5.3.1. If you finance this contract with a loan (e.g., via purchase on account through Klarna) and later cancel it, you are also no longer bound by the loan agreement, provided both contracts constitute a single economic unit. This is particularly likely to be the case if we are also your lender or if your lender uses our services for the financing. If the loan has already been disbursed to us when the cancellation takes effect, your lender assumes our rights and obligations under the financed contract with respect to the legal consequences of the cancellation or return. The latter does not apply if this contract concerns the acquisition of financial instruments (e.g., securities, foreign currency, or derivatives). If you wish to avoid any contractual obligation as far as possible, exercise your right of cancellation and also cancel the loan agreement if you are entitled to do so.
5.4. FAIR USE GUIDELINES
NA-KD is committed to reducing its CO2 emissions. We are continuously taking measures to shrink our environmental footprint, for example through carbon-neutral deliveries and returns, or sustainable collections.
As proud as we are to offer you the ultimate customer experience, we also take violations of our free returns policy very seriously.
Where appropriate and necessary, we will review unusual return activity and take appropriate action. Should we determine that you have systematically abused our generous return policy, we reserve the right to refuse future orders from you or to temporarily or permanently deactivate your account.
If your account has been deactivated and you believe we have made a mistake, please contact our customer service. The above provisions do not preclude the return/complaint of items already purchased.
6. GIFT CARDS & VOUCHERS
6.1 NA-KD Gift Cards
NA-KD gift cards can only be purchased on the website using a credit card. Each individual NA-KD gift card purchase is limited to a maximum value of SEK 1,500. The minimum value for a NA-KD gift card is SEK 100. You cannot increase or decrease the balance on your NA-KD gift card once the purchase is complete.
NA-KD gift cards will be sent to the email address you provided at checkout.
NA-KD gift cards are valid for 12 months from the date of purchase. Once the validity period has expired, the NA-KD gift card can no longer be used as a payment method for purchases. It also cannot be reactivated, and any remaining unused value cannot be refunded.
Please contact our customer service if you would like to receive an NA-KD gift card in a different currency.
NA-KD gift cards can be used until the balance on the card is zero. Once the balance on the NA-KD gift card is zero, the card is invalid and cannot be reactivated or used again.
NA-KD gift cards can only be used for purchases on the website and up to the available balance on the NA-KD gift card. If you wish to purchase a product that exceeds the balance on the NA-KD gift card, you will need to add an additional payment method to pay the remaining amount and complete the purchase.
NA-KD cannot be held liable for NA-KD gift cards that are lost, stolen, or damaged after activation.
Orders placed using an NA-KD gift card should be returned or cancelled in accordance with these terms and conditions and our return policy.
The refund will be issued to your NA-KD gift card. If you partially paid for your order using another payment method, you will receive your refund to that other payment method, and the remaining amount will be refunded to your NA-KD gift card.
6.2 NA-KD voucher
In certain cases, NA-KD may issue a voucher that can be used by the customer. The NA-KD voucher will be created and sent to the email address you provided at checkout. The voucher is valid for 6 months from the date of issue.
Please note that the NA-KD voucher can only be used for purchases on the website and up to the voucher's available balance. If you wish to purchase a product whose balance exceeds the voucher amount, you will need to add an additional payment method to pay the remaining balance and complete the purchase.
NA-KD cannot be held liable for NA-KD vouchers that are lost, stolen or damaged after activation.
Orders placed using an NA-KD voucher should be returned or cancelled in accordance with these terms and conditions and our return policy.
Refunds will be issued to your NA-KD gift card. If you partially paid for your order using a different payment method, your refund will be issued to that other payment method, and the remaining amount will be credited to your NA-KD gift card.
7. LIMITATION OF LIABILITY AND WARRANTY
7.1. We make no warranties regarding this website or the information, materials, and content provided. We do not guarantee that the website will be continuously available or that the information on this website is truthful, non-misleading, or accurate.
7.2. Any information and content on the website should not be construed by NA-KD as advice of any kind.
7.3. You agree not to use any of our products for commercial, business, or resale purposes, and we exclude liability for lost profits, loss of contracts, loss of business, loss of business opportunities, loss of chances, or loss of reputation.
8. TRADEMARK RIGHTS
8.1. The trademarks, names, and logos displayed on the website are registered and unregistered trademarks of NA-KD. Prior written authorization from NA-KD is required for the use of any trademarks, images, or videos from the website. Therefore, it is strictly prohibited to copy, reproduce, download, publish, transmit, or distribute any documents originating from the website in any way.
9. CUSTOMER COMPLAINTS
9.1. We take all complaints very seriously and try to resolve disputes as soon as they arise. Customers who wish to file a complaint are encouraged to contact us as soon as possible. 10. DATA PROTECTION
10.1. Please note our privacy policy , which forms part of these terms and conditions.
11. CONTRADICTIONS IN THE GENERAL TERMS AND CONDITIONS
11.1. If there are any conflicts or contradictions between the General Terms and Conditions of this website and other relevant provisions, policies, or notices, the other relevant provisions, policies, or notices that specifically refer to a particular section of NA-KD will no longer be valid.
12. SEPARATION
11.1. Should any provision of these General Terms and Conditions be unenforceable or invalid in any jurisdiction, court or authority, the remaining provisions shall remain in full force and effect.
13. STATUTORY GUARANTEE OF CONFORMITY
13.1. Should you discover any defects in the items you purchased, NA-KD adheres to all statutory warranty provisions. Therefore, you have up to 3 years from the date you receive your items to assert your statutory warranty rights. You must act within a reasonable period after discovering the defect. A complaint made within 2 months is always considered to have been made within a reasonable period. Please contact our customer service department.
14. LAWS AND LEGAL DISPUTES
14.1. These General Terms and Conditions are governed by Swedish law.
14.2. Contracts concluded via the website, and all disputes arising from or in connection with them, are governed by Swedish law. An amicable solution (through an ombudsman system) will be considered before any legal remedy. Should this solution fail, Swedish courts have non-exclusive jurisdiction to settle disputes arising from these Terms and Conditions. This provision shall not deprive European consumers of their national statutory rights.
14.3. In the event of a legal dispute or claim relating to these General Terms and Conditions, we will comply with the decision of the Swedish National Board for Consumer Complaints or the corresponding authority of the respective country.
